Terms & policies
Everything worth knowing before you order a painting, print or portrait: how the site works, how to cancel, what happens to your information, and how the site is accessible to everyone.
Terms of use
Use of the site, including purchases made through it, is subject to the terms below.
Who we are
The site is operated by Avigail Sarid, watercolour painter, Exempt dealer (osek patur) · no. [to be completed], Ein Karem D 22, Jerusalem. For any enquiry: avigail.watercolor@gmail.com or 052-6482107.
The works on the site
- An original painting is a unique work. Once sold it is marked “sold” and is no longer available.
- A print is made to order by a professional fine-art print lab, in the size and on the paper you choose, and shipped from the lab directly to you.
- A digital file is a high-resolution file of the work, for home use and a single print for personal use. The terms of use for the file are set out below.
- A commissioned portrait is painted especially for you, according to details we agree in writing in advance.
Watercolour is a living medium, and colours on screen may differ slightly from the original. The room preview on each work page is an illustration, and its scale is approximate. Exact dimensions are listed on each work page.
Prices and payment
Prices on the site are in Israeli shekels. The business is registered as an exempt dealer (osek patur), so no VAT is charged, and you will receive a receipt by email. Shipping costs are shown before you confirm your order. Payment is processed by a secure payment provider, and your card details are never stored by me.
An order is confirmed once the card company approves it. If an original painting sells at the same time, or if there is an obvious pricing error, I will contact you and cancel the order with a full refund.
Shipping and pickup
Courier delivery to your door costs ₪35, and is free on orders over ₪400. The estimated delivery time is 7–10 business days, and it is also shown when you order.
Prints are made to order and shipped from the lab directly to the address you give, in protective packaging. An original painting is carefully packed at the studio, protected from moisture and knocks.
You can also collect your order from the studio in Ein Karem by appointment, with no shipping fee. For now we ship within Israel only; there is no international shipping.
A digital file is sent as a download link to the email address you give, within 24 hours of payment.
Digital file — licence
Buying a digital file gives you a personal, non-exclusive, non-transferable licence to print one copy of the work for private home use.
- You may not print further copies, or sell, pass on, share or publish the file.
- You may not use the file, or a print made from it, for any commercial purpose, including products, advertising and training artificial intelligence systems.
- The copyright in the work remains mine.
The download link is valid for a limited time. If you didn't manage to download the file, write to me and I'll send a new link.
Commissioned portraits
A commissioned portrait starts with a conversation and a written summary of the details: who is in the painting, the size and the date. [to confirm]
- A 50% deposit holds your place in the diary, and the balance is paid when the painting is ready, before shipping. [to confirm]
- At the sketch stage you can ask for up to two rounds of changes to the composition, and once the painting is ready you can ask for one gentle correction. [to confirm]
- The estimated working time is 4–6 weeks, so it's best to get in touch about 8 weeks before the occasion. [to confirm]
Cancellation terms for commissioned portraits are set out under Cancellations & returns.
Copyright
All works, photographs and texts on the site are my protected works. Buying a painting or print transfers ownership of the physical copy to you, not the copyright.
The works may not be copied, printed, reproduced or used commercially, including for training artificial intelligence systems, without written permission. Sharing on social media with credit and a tag is warmly welcome.
Liability and law
I make every effort to keep the information on the site accurate and up to date, but errors may occur. My liability is limited to the price actually paid, as far as the law allows. These terms are governed by Israeli law, and the courts of Jerusalem have jurisdiction.
Cancellations & returns
This policy follows the Israeli Consumer Protection Law, 5741-1981, and the Consumer Protection Regulations (Cancellation of Transaction), 5771-2010.
Cancelling a purchase
You may cancel the purchase of an original painting or print within 14 days of the day you receive the product, or of receiving the transaction details, whichever is later. Your refund will be issued within 14 days of receiving the cancellation notice, to the same payment method, less a cancellation fee of 5% of the price or ₪100, whichever is lower.
The work must be returned in its original condition and in the packaging it was sent in. Return shipping is at your expense, unless the cancellation is due to a defect or mismatch.
Digital files
A digital file is “information” as defined in the Israeli Computers Law, 5755-1995, and by law the purchase cannot be cancelled once the download link has been sent to you. If the file is faulty, won't open or doesn't match the work you ordered, write to me and I'll send a working file or refund you in full.
Personal commissions
By law, there is no right to cancel goods made especially for the consumer. A commissioned portrait, commissioned painting, or a print in a size or framing not offered on the site therefore cannot be cancelled once work has begun.
A commissioned portrait can be cancelled until you approve the sketch, and your deposit is returned less the cost of the sketch. Once the sketch is approved, the painting is made especially for you and cannot be cancelled. [to confirm]
Senior citizens, people with disabilities and new immigrants
Senior citizens, people with disabilities and new immigrants (up to five years from immigration) may cancel within four months of receiving the product, if the transaction involved a conversation between us, including by phone or WhatsApp. Appropriate ID must be presented when cancelling.
A work that arrived damaged
If the work arrived damaged or different from what you ordered, photograph it with the packaging and send it to me. I'll arrange a replacement or a full refund, including shipping, with no cancellation fee.
How to cancel
Send a message by WhatsApp (052-6482107), email (avigail.watercolor@gmail.com) or phone, with your full name, order number and phone number. I'll confirm receipt in writing and arrange the return of the work with you.
Privacy policy
I collect only the information needed to send you a work and answer your enquiries. This policy follows the Israeli Protection of Privacy Law, 5741-1981, and the regulations under it.
What information is collected
- Name, phone, email and shipping address, when you order or contact me.
- Photos and details you send for a commissioned portrait.
- General technical information about use of the site, such as browser type and pages viewed.
Payment details are processed directly by the payment provider and never reach me.
What it's used for
To fulfil and ship your order, issue a receipt, answer enquiries and meet legal obligations. Updates about exhibitions and new prints are sent only if you explicitly asked for them, and you can unsubscribe at any time.
Who it's shared with
Only those needed to provide the service, and only as strictly necessary: the payment provider, the print lab that ships your print (name, phone and shipping address), the courier, the site's hosting and email-delivery providers, and the accountant. I never sell or rent information to anyone.
Cookies
The site stores necessary information in your browser, such as your cart, language and the accessibility settings you chose. Aggregated statistics that don't identify you personally are also collected. You can block cookies and local storage in your browser settings, but parts of the site may not work properly.
Photos for portraits
The photos you send are used only for the work itself. The finished work is published on the site or social media only if you approve.
Security and retention
Connections to the site are encrypted (HTTPS), and access to information is restricted. Information is kept as long as it's needed for the purpose it was given for, or as required by law, for example accounting records.
Your rights
You may review the information held about you, ask to correct or delete it, and unsubscribe from the mailing list. Write to me at avigail.watercolor@gmail.com and I'll handle your request within 30 days.
Accessibility statement
I believe art should be open to everyone. I've put thought into making sure anyone can browse the site, enjoy the paintings and order easily, including people with disabilities.
Accessibility level
I work to make the site meet the Israeli Equal Rights for Persons with Disabilities (Service Accessibility Adjustments) Regulations, 5773-2013, and Israeli Standard 5568 at level AA, in line with the international WCAG 2.2 guidelines of the W3C at level AA. Accessibility is checked and improved on an ongoing basis — if you come across something that isn't accessible, I'd like to know.
What has been made accessible
- Full keyboard navigation, with a clear focus indicator, and a “Skip to main content” link at the top of every page.
- Screen reader support: alternative text for images, properly structured headings and labels for every button.
- Colour contrast at level AA, and text enlargement up to 200% without losing content.
- Fully responsive on mobile, with tap targets of at least 44 pixels.
- Respects the operating system's “reduce motion” setting.
Accessibility adjustments menu
Every page has a floating accessibility button in the corner. It lets you enlarge text, increase contrast, switch to grayscale, highlight links, use a readable font, increase spacing, stop animations and enlarge the cursor. Settings are kept as you move between pages.
Known limitations and alternatives
- The on-the-wall preview is based on dragging. Exact dimensions of every work are listed on its page.
- The map on the home page is an extra way to discover paintings. Every painting on it also appears in the list on the gallery page.
- PDF files from past exhibitions may not be fully accessible. I'm happy to send the content in an accessible format on request.
Visiting the studio
The studio in Ein Karem is open to visits by appointment. If you need any adjustment to get here, write to me before your visit and I'll take care of it.
